DRIVER CPC

T.M.S. are now approved by the Driver Standard Agency to deliver period training for driver CPC qualification.

In 2003 the EU passed the Driver CPC Directive which effects all LGV and PCV drivers.

The directive become effective from 10th September 2008 for the PCV sector and from 10th September 2009 for the LGV sector.

The aim of the directive is to increase the amount of knowledge that new drivers need before they can drive and to introduce a compulsory 35 hours of accredited training for all drivers every five years.

TMS will be offering all our clients accredited training based around the application of the regulations.

Tachograph use (analogue and digital), Drivers Hours & Working Time regulations will be covered in a seven hour module conducted on your premises (subject to suitability) or in our training school.

The course designed by TMS can be conducted in a full day or in two half day modules.

Guidance on the Road Transport (Working Time) Regulations 2005

Brief overview
The Road Transport (Working Time) Regulations 2005 (SI 2005 No. 639 - "the/these
Regulations"), came into force on 4 April 2005. The Regulations implement European
Directive 2002/15/EC, and apply to "mobile workers" (basically drivers, crew and other
travelling staff) who operate on vehicles which are subject to Regulation (EC) No 561/2006
("the European drivers' hours rules") or, in some cases, the AETR. Mobile workers are
required to comply with the Regulations as well as the existing European drivers' hours rules.
There is no opt-out from the Regulations.

Mobile workers who only occasionally carry out "in-scope" work are not required to comply
with the working time limits under the Regulations (for this to apply, mobile workers must
meet the "occasional mobile worker" criteria given in Section 1.3). "Self employed drivers"
are exempt from the Regulations until March 2009 - for this exemption to apply, drivers must
satisfy criteria given in Section 1.4.

The Regulations introduce limits on weekly working time (excluding breaks and periods of
availability) and a limit on the amount of work that can be done within a 24 hour period, for
those who operate on night shifts (see Sections 3 and 4 on limits under the Regulations). They
also specify how much continuous work can be done before taking a break and introduce daily
and weekly rest limits for the crew and travelling staff.

Drivers Hours for EEC Regulations – April 11th 2007

1. EC FIXED WEEK
00.00 hrs Monday to 24.00 hrs Sunday. The fixed week is used as a measuring period to ascertain as to whether driving limits are obeyed. If any rest periods are reduced legally the fixed week is then used to determine as to when compensation is required.

2. DAILY DRIVING
The daily driving limit is 9 hours but this may be extended to 10 hours twice in the fixed week. Weekly driving limit is 56 hours.

3. DRIVING OVER TWO CONSECUTIVE WEEKS
Driving cannot total more than 90 hours.

4. BREAKS FROM DRIVING
The maximum period of continuous driving is 4.5 hours. After this the driver must take a Break of at least 45 minutes before he/she begins to drive again.
